Section 01

Acceptance of terms

By creating a CarbTrack account or using the CarbTrack mobile application ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these Terms, you must not create an account or use the App.

These Terms apply to all users of CarbTrack, including users who access the App on iOS or Android devices. Your use of CarbTrack is also subject to our Privacy Policy, which explains how we collect, use, and protect your data.

Section 02

Eligibility

CarbTrack is intended for users aged 13 and older. By creating an account, you represent that you are at least 13 years of age. If you are between 13 and 18, you must have a parent or legal guardian review these Terms and consent to your use of the App.

If you are a parent or guardian and believe a child under 13 has created an account, please contact us immediately at [email protected] so we can delete it.

Section 03

Medical disclaimer — important

CarbTrack is a self-management logging and tracking tool designed to help you record meals, glucose readings, insulin doses, and related health data. The following features are provided for informational and educational purposes only:

• AI carb estimation: when you scan a meal photo, the carb, fat, and protein estimates are generated by OpenAI's vision model. These are algorithmic estimates — not laboratory measurements — and may be inaccurate. Always double-check against nutrition labels or professional dietary guidance.
• Insulin dose calculations: the App may display a "recommended dose" based on your configured insulin-to-carb ratio and meal carb estimate. This is a mathematical convenience calculation only. It does not account for active insulin (insulin on board), exercise, illness, stress, or other factors that affect insulin needs. You must verify all doses independently.
• Glucose trends and insights: daily summaries, weekly trends, and meal-impact reports are generated from your logged data. They are not diagnostic tools and should not replace interpretation by a healthcare professional.
• CGM data: glucose readings imported from Dexcom or LibreView are displayed as-is from the CGM provider. CarbTrack does not modify, validate, or interpret CGM data for clinical use.

Do not delay or disregard professional medical advice because of information you see in CarbTrack. In case of a medical emergency, contact your healthcare provider or emergency services immediately.

Section 04

Your account

• Authentication: CarbTrack uses Clerk for account creation and sign-in. You are responsible for maintaining the security of your login credentials and for all activity under your account.
• Accurate information: you agree to provide accurate, current, and complete information when creating your account and setting up your health profile (diabetes type, weight, insulin regimen, glucose targets, etc.). Inaccurate health profile data may result in incorrect insulin dose calculations.
• One account per person: you may not create multiple accounts to circumvent restrictions, abuse community features, or misrepresent your identity.
• Account termination: we reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion. You may request account deletion at any time by contacting us. See our Privacy Policy for data deletion timelines.

Section 05

User content & community rules

CarbTrack includes community features where you can create posts, share meal experiences, comment on other users' posts, and join community rooms. By posting content, you agree to the following:

• You own your content: you retain ownership of posts, comments, and images you create. By posting, you grant CarbTrack a non-exclusive, royalty-free, worldwide license to display and distribute your content within the App to other users, solely for the purpose of operating the community features.
• No sensitive health data in public posts: community posts are visible to other CarbTrack users. Do not include full medication doses, personal identifiers, or detailed medical records in public posts. Share your experiences, not your prescriptions.
• Prohibited content: you may not post content that is illegal, harassing, hateful, spammy, misleading, sexually explicit, or that promotes self-harm, violence, or dangerous health practices.
• We may moderate: we reserve the right to remove posts, comments, or images that violate these Terms or our community standards, without prior notice. Repeated violations may result in account suspension or termination.
• Report violations: if you see content that violates these Terms, please report it to [email protected].

Section 06

Third-party services & integrations

CarbTrack integrates with several third-party services to deliver core functionality. By using these features, you also agree to the respective third-party terms:

• Clerk: authentication provider. Governed by Clerk's Terms of Service.
• Dexcom: CGM data synchronisation via OAuth. Subject to Dexcom's API terms and your Dexcom user agreement. Only active when you explicitly connect your Dexcom account.
• LibreView (Abbott): CGM data synchronisation. Subject to Abbott's terms of service. Only active when you explicitly connect your LibreView account.
• OpenAI: AI-powered meal photo analysis. Meal photos are sent to OpenAI's API under their Terms of Use. We use API services where data is not used for model training without consent.
• Cloudflare R2: storage for meal photos, community post images, and profile avatars. Subject to Cloudflare's terms.
• Expo: push notification delivery. Your device push token is registered with Expo's notification service.
• Sentry: error and performance monitoring. Crash reports, error logs, and diagnostic data are sent to Sentry under their Terms of Service. Sentry's data processing is governed by their Data Processing Agreement.

We are not responsible for the availability, accuracy, or data handling practices of these third-party services. If a third-party service becomes unavailable, certain CarbTrack features (such as CGM sync or AI meal scanning) may be temporarily or permanently affected.

Section 07

Intellectual property

The CarbTrack App, including its name, logo, design, code, and all original content (excluding user-generated content), is owned by Kouidev and protected by applicable intellectual property laws.

• You may not copy, modify, distribute, sell, or reverse-engineer any part of the App without our prior written consent.
• You may not use the CarbTrack name, logo, or branding in any way that suggests endorsement, affiliation, or sponsorship without permission.
• You retain full ownership of your health data, meal logs, glucose readings, and community posts. We claim no ownership over your personal data or user-generated content.

Section 08

App availability & updates

• No uptime guarantee: we strive to keep CarbTrack available, but we do not guarantee uninterrupted access. The App may be unavailable during maintenance, updates, or due to circumstances beyond our control (e.g. cloud provider outages, third-party API disruptions).
• Updates: we may release updates to the App from time to time to add features, fix bugs, or improve security. You are encouraged to install updates promptly. We may discontinue certain features or the App entirely at our discretion.
• Device compatibility: CarbTrack requires a compatible iOS or Android device with an active internet connection. You are responsible for any data charges from your mobile carrier.

Section 09

Limitation of liability

To the fullest extent permitted by applicable law:

• CarbTrack is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy of carb estimates or insulin dose calculations, or uninterrupted operation.
• Kouidev and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to health complications, data loss, or emotional distress — arising from your use of or inability to use the App.
• Our total liability for any claim arising from these Terms or your use of CarbTrack shall not exceed the amount you paid us (if any) in the 12 months preceding the claim. CarbTrack is currently a free service; if no fees were paid, our liability is limited to the minimum permitted by law.
• Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g. liability for gross negligence or willful misconduct in certain jurisdictions).

Section 10

Indemnification

You agree to indemnify and hold harmless Kouidev, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms.
• Your user-generated content, including claims that your content infringes a third party's rights.
• Your misuse of the App, including reliance on AI carb estimates or insulin calculations contrary to medical advice.

Section 11

Termination

• By you: you may stop using CarbTrack and request account deletion at any time by contacting [email protected]. Your data will be handled as described in our Privacy Policy.
• By us: we may suspend or terminate your account without prior notice if you violate these Terms, including community rules, or if required by law.
• Survival: sections on Medical Disclaimer (Section 03), Intellectual Property (Section 07), Limitation of Liability (Section 09), Indemnification (Section 10), and Governing Law (Section 13) survive termination of these Terms.

Section 12

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you via an in-app notice or email before the changes take effect. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of CarbTrack after the effective date constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the App and may request account deletion.

Section 13

Governing law

These Terms are governed by and construed in accordance with the laws of Algeria, without regard to conflict of law principles. Any disputes arising from these Terms or your use of CarbTrack shall be resolved exclusively in the competent courts of Algeria.

If you are accessing CarbTrack from outside Algeria, you are responsible for compliance with local laws to the extent they apply.
